A US federal appeals court has again ruled against President Joe Biden’s national vaccine mandate for companies with 100 or more workers, shredding the policy as “staggeringly overbroad” and an abuse of “extraordinary power.”
The Fifth Circuit Court of Appeals issued a stark rebuke to Biden’s vaccine requirement for larger American companies in a ruling on Friday, stating that the Occupational Safety and Health Administration (OSHA) – the federal agency tapped to enforce the mandate – was not created to “make sweeping pronouncements on matters of public health affecting every member of society in the profoundest of ways.”
“The mandate is staggeringly overbroad,” Judge Kurt Engelhardt said, noting that it does not take into account the diversity of workplaces across the country, nor the fact that Covid-19 “is more dangerous to some employees than to other employees.” As an example, he compared a hypothetical 28-year-old truck driver who works in isolation to a “62-year-old prison janitor” employed in more cramped conditions.

Ein US-Bundesberufungsgericht hat erneut gegen das nationale Impfstoffmandat von Präsident Joe Biden für Unternehmen mit 100 oder mehr Beschäftigten entschieden und die Politik als „erstaunlich überzogen“ und als Missbrauch „außerordentlicher Macht“ zerfetzt.
Das Berufungsgericht des fünften Bezirks tadelte Bidens Impfstoffbedarf für größere amerikanische Unternehmen in einem Urteil vom Freitag und stellte fest, dass die Occupational Safety and Health Administration (OSHA) – die Bundesbehörde, die zur Durchsetzung des Mandats eingesetzt wurde – nicht geschaffen wurde, um „ weitreichende Erklärungen zu Fragen der öffentlichen Gesundheit abgeben, die jedes Mitglied der Gesellschaft auf tiefste Weise betreffen.“
„Das Mandat ist erschreckend weit gefasst“, sagte Richter Kurt Engelhardt und stellte fest, dass es weder die Vielfalt der Arbeitsplätze im ganzen Land berücksichtigt noch die Tatsache, dass Covid-19 „für einige Mitarbeiter gefährlicher ist als für andere.“ Als Beispiel verglich er einen hypothetischen 28-jährigen Lkw-Fahrer, der isoliert arbeitet, mit einem „62-jährigen Gefängnishausmeister“ , der unter beengteren Verhältnissen beschäftigt ist.

Governor Ron DeSantis Calls Special Session of the Florida Legislature to Protect Florida Jobs
Today, Governor Ron DeSantis was joined by Attorney General Ashley Moody, Florida’s Surgeon General Dr. Joseph Ladapo, and Floridians who have lost their jobs or are having their employment threatened due to vaccine mandates to call a Special Session of the Florida Legislature to provide protections for employees. 
 
“Your right to earn a living should not be contingent upon COVID shots,” said Governor Ron DeSantis. “When the vaccines first came out, we worked very hard to provide it, particularly to our elderly, but we said from day one: we will make it available for all, but we will mandate it on none because ultimately we want individuals to make the determinations about what is right for them. I want a state in which people are able to maintain their livelihoods, earn a living, and provide for their families. And if the federal government or big corporations are hurting people, then we have a responsibility to step up and lead.”
 
“Mandates have no place in the free state of Florida,” said Lieutenant Governor Jeanette Nuñez. “I am proud to stand with Governor DeSantis to provide protections for employees facing discrimination over vaccine status. Our administration will continue to fight for freedom.”
 
“I am proud to stand with Governor Ron DeSantis to push back against unlawful vaccine mandates,” said Attorney General Ashley Moody. “We will always fight illegal government actions that negatively impact first responders, America’s workers, and public safety.”
 
“Condemning Americans to financial instability is detrimental to the well-being of this country and to public health,” said Dr. Joseph Ladapo, Surgeon General of Florida. “The Governor has made it clear: Florida will not stand by and allow hard working citizens to be subjected to unemployment because they are being forced to show vaccine documentation, especially those who have remained on the front lines of COVID-19 for nearly two years now. The Department of Health will continue to protect Floridians through multi-faceted and data-driven solutions, not overreach.”
 
During this Special Session, Governor DeSantis is asking the Florida Legislature to provide protections for employees facing termination because of unfair, discriminatory COVID-19 vaccine mandates and to reaffirm that government entities including school districts may not fire any employee based on COVID-19 vaccine status. Violating government entities should be held accountable. Employers’ broad liability protections should also be reevaluated if they harm employees through vaccine mandates.
 
In addition, we are asking the Florida Legislature to provide greater protections to parents to manage the health care decisions of their children, including the freedom to opt their children out of mask mandates. According to Florida Department of Health data over the last twelve to fourteen months, COVID-19 infection data from Florida counties reflects no meaningful difference between counties with parent opt-outs for mask requirements. 
 
The Governor was also joined at today’s event by Floridians who shared their stories about being terminated from their jobs or having their livelihood threatened due to vaccine mandates.

Texas Executive Order Bans State-Mandated Vaccine Passports

Gov. Greg Abbott erließ am Dienstag eine Durchführungsverordnung, die staatliche Behörden daran hindert, Texaner zur Bereitstellung sogenannter COVID-19-Impfpässe zu verpflichten, um Dienstleistungen zu erhalten oder Gebäude zu betreten.

„Ein Impfpass ist ein Begriff, der verwendet wurde, um sich auf eine Dokumentation zu beziehen, aus der hervorgeht, dass eine Person gegen das neuartige Coronavirus geimpft wurde. Wie ich schon immer gesagt habe, sind diese Impfstoffe immer freiwillig und werden niemals erzwungen“

Idaho bans ‘vaccine passports as well

Gouverneur Brad Little hat eine Durchführungsverordnung erlassen, die sogenannte „Impfpässe“ in seinem Bundesstaat verbietet. Inmitten eines nationalen Streits über die Impfpässe ist Idaho der dritte Staat, der sie verbietet.

„Impfpässe schränken den freien Fluss des Handels in einer Zeit ein, in der das Leben und die Wirtschaft zur Normalität zurückkehren,“

sagte Little am Mittwoch vor der Unterzeichnung der Anordnung, die alle staatlichen Stellen in Idaho verbietet, einen Nachweis der Impfung zu verlangen, um Dienstleistungen zu erhalten oder Einrichtungen zu betreten.

Little bedankte sich bei den 500.000 Bürgen in Idaho, die sich dafür entschieden haben, sich impfen zu lassen, warnte aber, dass der obligatorische Nachweis der Impfung

Unter Berufung aus „Nutzungsbedingungen“ entfernt youtube Roundtable-Video mit dem Gouverneur von Florida, DeSantis, und Anti-Lockdown-Gesundheitsexperten

YouTube has taken down a video of a public health roundtable hosted by Florida Governor Ron DeSantis and a number of medical experts voicing skepticism about lockdowns, saying that it violated the platform’s community standards.

The nearly two-hour video was first streamed on the channel of a Florida CBS affiliate in mid-March, in which the governor spoke at length at the Florida state capitol with four public health experts hailing from Stanford University, the University of Oxford and Harvard Medical School.

While the roundtable remains accessible through an archived link, YouTube sent the video down the memory hole sometime this week, as was first noted by Jeffrey Tucker of the American Institute for Economic Research on Wednesday. The page previously hosting the video now gives a brief notice: “This video has been removed for violating YouTube’s Community Guidelines.”

Zwei weitere Bundesstaaten heben Maskenpflicht auf

Utah und Alabama heben ihre Maskenpflicht auf. Somit muss man in 18 Bundesstaaten in den USA keine Schutzmasken mehr wegen Corona tragen.     

Zuerst sagte Alabamas Gouverneurin Kay Ivey, dass sie die Maskenpflicht am Freitag auslaufen lassen werde.

Und Utah hat ein neues Gesetz erlassen, das die landesweite Maskenpflicht ab diesem Samstag beendet. Aber die Landkreise können die Maskenpflicht fortsetzen, wenn sie es wollen.

Davor hatten die 5 Bundesstaaten Texas, Montana, Iowa, North Dakota und Mississippi ihre Maskenpflicht abgeschafft. Die 11 Bundesstaaten, Alaska, Arizona, Florida, Georgia, Idaho, Missouri, Nebraska, Oklahoma, South Carolina, South Dakota und Tennessee nie eine eingeführt.
